1. Acceptance of Terms
By creating an account or using saymyname ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 16 years old to create an account and use saymyname. By registering, you confirm that you meet this age requirement. We do not knowingly allow anyone under 16 to use the Service.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and truthful information when registering
- Keep your account details up to date
- Notify us immediately if you suspect unauthorised access to your account
- Not share your account with or transfer it to another person
4. The Service
saymyname allows you to create a personal pronunciation page that displays your name, phonetic spelling, audio recording, photo, and professional details. Pages can be shared with anyone via a link. The Service is provided on a Free and Premium basis:
- Free plan: 1 pronunciation page, standard fonts, standard backgrounds
- Premium plan (£1.00/month): Up to 5 pages, custom fonts, gradient backgrounds, page analytics, priority support
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where possible.
5. Your Content
You retain ownership of all content you upload to saymyname, including your name, audio recordings, photos, and profile information. By uploading content, you grant saymyname a non-exclusive, royalty-free licence to store, display, and deliver that content solely for the purpose of operating the Service.
You are solely responsible for the content you upload. You must not upload content that:
- Is false, misleading, or impersonates another person
- Is offensive, harmful, or violates any applicable law
- Infringes the intellectual property rights of any third party
- Contains malware, viruses, or other harmful code
We reserve the right to remove content that violates these terms without prior notice.
6. Contact Requests
saymyname includes a contact request feature that allows visitors to request access to private contact details on a pronunciation page. You, as the page owner, have full control over approving or denying these requests. By submitting a contact request, visitors agree that their name and email address will be shared with the page owner for the sole purpose of that request.
7. Billing and Subscriptions
Premium subscriptions are billed monthly at £1.00/month and are processed securely by Stripe. By subscribing, you authorise us to charge your payment method on a recurring monthly basis until you cancel.
You may cancel your subscription at any time through your account settings (Profile → Subscription → Manage). Cancellation takes effect at the end of the current billing period — you retain access to Premium features until then. We do not offer refunds for partial billing periods.
If a payment fails, we may suspend your Premium access until payment is resolved.
8. Acceptable Use
You agree not to use the Service to:
- Harass, abuse, or harm other users or visitors
- Scrape, copy, or systematically extract data from the platform
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Use automated tools to create accounts or interact with the Service
- Circumvent any rate limiting, security, or access controls
- Violate any applicable local, national, or international law or regulation
9. Intellectual Property
The saymyname name, logo, design, and platform code are the intellectual property of saymyname. Nothing in these terms grants you any right to use our branding or intellectual property outside of normal use of the Service.
10. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or free from security vulnerabilities, although we take reasonable steps to ensure reliability and security.
To the fullest extent permitted by law, saymyname shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of data or loss of revenue.
Nothing in these terms limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.
11. Termination
You may delete your account at any time from your Profile Settings, which will permanently remove your data from our systems. We may suspend or terminate your account if you breach these terms, with or without prior notice depending on the severity of the breach.
12. Governing Law
These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to These Terms
We may update these terms from time to time. We will notify you of significant changes by posting the updated terms on this page and updating the "Last updated" date. Continued use of saymyname after changes constitutes acceptance of the updated terms.
